KILVE EVENTS LIMITED TICKETING TERMS AND CONDITIONS
1. Definitions and Interpretations
Event: Music concert, participation event or any other live event taking place at any Venue.
Event Organiser: Kilve Events Limited, Overlands, Kilve, Somerset, TA5 1SQ
Force Majeure: means any cause beyond the Event Organiser’s control, including, without limitation, any act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, national defence requirements or acts or regulations of national or local governments.
Ticket: means a validly issued paper Ticket, electronic Ticket, wristband, Right of Admission Email or any other device giving the owner the right to attend an Event whether purchased or allocated free of charge by the Event Organiser.
Right of Admission Email: means that the recipient has been issued an email which permits them the opportunity to attend the Event subject to any restrictions stated therein.
Venue: Any area in which Event(s) take place.
You/Your: Any person seeking admission to an Event at a Venue.
2. General Terms
By possessing an issued Ticket(s), you demonstrate your agreement to the following terms and conditions with Kilve Events Limited (the “Event Organiser”). Any person who is in breach of these terms and conditions (the “Ticketing Terms and Conditions”) may be removed from the Event without right to refund, compensation or re-admission. Please note, any specific terms stated at the point of Ticket purchase shall take precedence over these Ticketing Terms and Conditions.
3. Tickets
Once issued, Tickets cannot be transferred, exchanged, refunded or returned unless approved in advance by the Event Organiser, or, if the Event is cancelled in accordance with the Cancellation Policy set out below.
By purchasing or otherwise being allocated a Ticket for yourself, or on behalf of another, you agree that the Tickets are for the use of the Ticket holder only and will not be resold or transferred. In the event of any resale or attempt to resell the Tickets via an auction site or any other means, the Event Organiser may identify the Ticket and invalidate it. The Event Organiser cannot be held responsible for any losses associated with Tickets that have not been validly issued by the Event Organiser and instead purchased via an auction site or through any other medium that provides resold, duplicated or invalid Tickets.
Only persons holding a valid Ticket will be admitted to the Event. By holding a valid Ticket you confirm that you are physically able to attend/take part in the Event and will comply with these Ticketing Terms and Conditions and any rules and regulations stipulated at the Event. You must keep your Ticket with you at all times throughout the Event for inspection If required by the Event Organiser.
4. Age Restrictions
Unless otherwise specified in the booking process children under 16 must be accompanied by an adult aged 18 or over who must also hold their own Ticket. For the avoidance of doubt, all persons under the age of 18 must have a valid Ticket in order to attend the Event.
The Event may be age restricted and it is the responsibility of the person who purchases the Tickets to check that they, and persons on whose behalf they purchase the Tickets for, comply with any applicable age restrictions before purchasing Tickets. If you attend an Event where age restrictions apply and/or if you are claiming a concession, you must be able to provide photographic proof of identity and age or entitlement, as appropriate. The Event Organisers reserve the right to refuse entry, without refund, to any person who is unable to provide such photographic proof.
It is each Event attendee’s responsibility to check the suitability of an Event for children attending regardless of any official age restrictions, including considering the type of audience that the Event is likely to attract and whether such an audience is a suitable environment for children. Refunds will not be issued if any aspect of an Event, including the behaviour of other audience members, causes offence to you or any children on whose behalf you have purchased Tickets.
5. At the Event
Entry to the Event is strictly subject to:
(i) the possession of a validly issued Ticket subject to capacity and/or any restrictions set out therein;
(ii) you providing the Event Organiser with a completed and signed participant disclaimer and/or proof of age (if you are requested to do so);
(iii) your compliance with any rules/instructions given by the Event Organiser or its authorised representatives; and
(iv) your consent to an inspection of personal belongings, bags, body checks etc.
The Event Organiser reserves the right to refuse admission to you and any other Ticket holder who appears to be under the influence of alcohol or any illegal substance, or, for any other reason where in the Event Organiser’s sole discretion the individual or group may affect the safety of the Event or anyone else attending the Event.
You and any other Ticket holder must comply with all relevant statutes, safety announcements, event and venue regulations whilst attending the Event. Any breach of any of these terms and conditions or any unacceptable behaviour likely to cause damage, nuisance or injury shall enable the Event Organiser to immediately eject you from the Event. In addition, any person found in possession of items listed below will be evicted and the items may be removed or temporarily confiscated by the Event Organiser. In particular (but without limitation) the following items are prohibited:
(i) glass of any sort;
(ii) legal highs or any other psychoactive substances;
(iii) laser pens and laser key rings;
(iv) aerosol cans, paints, or flammable liquids;
(v) fireworks; and/or
(vi) promotional and/or commercial objects and materials or goods with intent to sell and/or promote such items at the Event.
6. Filming / Photography
You and all Ticket holders acknowledge that the Event Organiser will film and photograph the Event and you and all other Ticket holder expressly and irrevocably give consent to the Event Organiser (and to any third party designated by the Event Organiser) to record, use and forward to third parties any images, recordings of your voice and any likeness of you and any other Ticket holder. You hereby irrevocably assign to the Event Organiser the entire copyright in any footage and/or photographs of the Event in perpetuity and grant to the Event Organiser all rights and consents necessary to enable the Event Organiser or its authorised third parties to make the fullest use footage and/or photographs (be it commercial, promotional or otherwise) recorded at the event by any and all means in any and all media, without further liability or acknowledgement to you.
You may make recordings (such as sound or video) at the Event but you agree that use of any such material is for private and personal purposes only and must not be distributed or exploited in any other manner.
7. Cancellation Policy
The Event Organiser reserves the right to make alterations to the Event which are not material in nature and no refunds will be available in respect of non-material alterations. A “material” change is a change to an Event which in the reasonable opinion of the Event Organiser, makes the Event materially different to the Event which purchasers of the Ticket could reasonably expect. Changes to start times, performance times, supporting acts and the use of alternate acts of similar standard in a show will not be a material change. A material change is judged by reference to the nature and billing of each Event.
It is the responsibility of the Ticket holder to check the website for the Venue, Event or Ticket Agent for news of any cancellation, postponement or alteration of the Event. Information on such matters will be made available on behalf of the Event Organiser as soon as reasonably practicable on our Facebook page.
Customers are advised that the Facebook page cannot always be updated immediately and that circumstances giving rise to cancellation or alterations can sometimes arise immediately prior to an Event.
The Event Organiser reserves the right to make alterations to the Event including, but not limited to times, dates, programmes and places, due to unforeseen circumstances including, without limitation, force majeure, safety and security concerns or decisions from any competent authority.
The Event Organiser will not be liable to you under these Ticketing Terms and Conditions to the extent that the failure is cause by a Force Majeure event.
The Event Organiser reserves the right to amend the Event format at their sole discretion or cancel the Event due to circumstances beyond its reasonable control or for any safety related reason. In the event of the Event being cancelled it shall provide the Participant with a full refund with no further liability whatsoever arising from such cancellation.
Nothing in these Ticketing Terms and Conditions shall limit Your statutory rights.
8. Collection of Information and Data Privacy
Information about how the Event Organiser may collect, process and store Your Personal Data for the Promotion and otherwise, can be found within our privacy policy which can be requested from kilveevents@yahoo.com.
9. Liability
If Tickets are purchased through a secondary ticketing agency and/or website, the Event Organiser disclaims any and all liability to you in relation to your use of such secondary ticketing agency and/or website.
It is your and any other Ticket holder’s responsibility to check the accuracy of the details on your Ticket; mistakes cannot always be rectified. When you receive your Tickets, please keep them safe as the Event Organiser cannot be held responsible for any Tickets which are lost or stolen (replacement Tickets cannot be issued).
If the Event Organiser breaches its obligations to you, or the Event Organiser is negligent and, as a result, you suffer any loss or damage in connection with attending the Event you may be entitled to claim for that loss:
(i) The Event Organiser will only be liable for your loss or damage up to an amount equal to the face value of the Ticket purchased by you, for the Event you are attending (if any);
(ii) The Event Organiser will not be liable for any loss or expenses incurred by you with your visit to the Event, or its cancellation, such as the cost of travel, accommodation or hospitality arrangements made in connection with any Event; and
(iii) The Event Organiser excludes all liability for any indirect or consequential losses arising howsoever.
Nothing in these terms shall be construed as excluding or restricting the Event Organiser’s liability for death or personal injury caused by the Event Organiser’s negligence nor for any other liability that may not be limited by law.
10. Enforcement and Assignment
To the fullest extent permissible in law, the Event Organiser shall be entitled to assign any and all of their rights and obligations under these Terms.
If any provision of these Terms is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Ticketing Terms and Conditions valid and enforceable.
11. Jurisdiction
These Ticketing Terms and Conditions are governed by English law and any disputes arising under them are subject to the exclusive jurisdiction of the English courts.
